Voter ID in Delaware

Delaware is a non-strict voter ID state.

You will be asked to show an acceptable ID to confirm your identity when voting in person.

If you are a registered voter but do not present an acceptable ID at the polling place, you may sign an affidavit and vote a regular ballot.

To vote absentee in Delaware, you need to be a registered voter and unable to go to your polling place for an acceptable reason.

A copy of your ID is not required when you vote by mail in Delaware.

Changing Your Legal Name

You must file a formal request with the Court of Common Pleas to change your name in Delaware.

You will be required to publish notice of your name change in a newspaper for a specific period of time.

If the court approves your name change, you will receive a court order that can be used to update the name on your ID documents.

Submit a written request to Delaware’s Office of Vital Statistics to amend your birth certificate.

To change the name on your Delaware birth certificate, you will need to provide:

  • sworn statement requesting name change on birth certificate
  • certified copy of name-change court order
  • copy of valid government-issued photo ID or certified copy of incorrect birth certificate (“pink or blue version”)
  • payment of applicable fees

Note: You must update your birth certificate with the state where you were born.

You must update your name with the Social Security Administration at least 48 hours before you can change your name on a Delaware-issued ID.

Visit a Delaware DMV office to change the name on your license or state ID.

You will need to provide a certified copy of your name-change court order.


Updating Gender Markers

Submit a written request to Delaware’s Office of Vital Statistics to amend your birth certificate.

You will need to provide a sworn statement from a medical or social service provider, stating that you have received care for the purpose of your gender transition. Care may be surgical, hormonal, psychological, or another form that is appropriate for your transition.

Note: You must update your birth certificate with the state where you were born.

To apply for an updated Delaware birth certificate, you will need to provide:

  • sworn statement requesting to amend gender marker on birth certificate
  • sworn statement from a medical or social service provider
  • copy of valid government-issued photo ID or certified copy of incorrect birth certificate (“pink or blue version”)
  • payment of applicable fees

Note: You must update your birth certificate with the state where you were born.

Visit Delaware DMV office and submit a completed Request for Gender Change on Driver License/Identification Card form (PDF).

The form must be signed by a medical or social service provider, but gender affirmation surgery is not required.
